End User License Agreement

1. Licence

We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to download, install and use the App on devices that you own or control, for your personal, non-commercial use, in line with this EULA, the Terms of Service and the usage rules of the app store you got the App from (the "Usage Rules"). On Apple devices, the App may also be used by other accounts in your Family Sharing group or volume purchasing, as the Usage Rules allow.

The App is licensed, not sold. We and our licensors keep all rights, title and interest in the App and its content, including all intellectual property rights. This EULA does not give you any rights to the App's source code.

2. Restrictions

Except as this EULA allows or as the law expressly permits, you must not:

• copy, modify, translate or create derivative works of the App;
• decompile, reverse engineer, disassemble or try to derive the App's source code;
• rent, lease, lend, sell, redistribute or sublicense the App;
• remove, alter or hide any copyright, trademark or other notices in the App;
• bypass, disable or interfere with security, content protection or age-restriction features of the App;
• use the App in a way that breaks the law or the Terms of Service.

3. Updates

We may release updates to fix bugs, improve security, add features or keep the App compatible with operating systems. Some updates may be required to keep using the App. Your consumer rights regarding digital content and services remain unaffected.

4. Data and privacy

We collect and use data from the App as described in our Privacy Policy.

5. In-app purchases

The App does not currently offer in-app purchases. When subscriptions, coins or unlocks become available, they will be sold through the app store's in-app purchase system and governed by section 7 of the Terms of Service and the app store's terms.

6. Termination

This EULA applies until you or we end it. You can end it by deleting the App from all your devices and, if you wish, deleting your account. Your licence ends automatically if you materially break this EULA. When it ends, you must stop using the App and delete it.

7. Warranty and liability

The App is provided "as is" and "as available" to the extent permitted by law. The disclaimers and limitations of liability in sections 12 and 13 of the Terms of Service apply to the App. Nothing in this EULA limits any rights you have under consumer law that cannot be limited.

8. Terms for apps downloaded from the Apple App Store

If you downloaded the App from the Apple App Store, the following also applies:

1. Acknowledgement. This EULA is between you and Ethereal Labs only, not with Apple Inc. ("Apple"). Ethereal Labs, not Apple, is solely responsible for the App and its content.
2. Scope of licence. Your licence is limited to using the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
3. Maintenance and support. Ethereal Labs is solely responsible for providing maintenance and support for the App, as set out in this EULA or as required by law. Apple has no obligation to provide any maintenance or support services for the App.
4. Warranty. Ethereal Labs is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses due to any failure to conform to a warranty are Ethereal Labs' sole responsibility.
5. Product claims. Ethereal Labs, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy or similar legislation.
6. Intellectual property rights. If a third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, Ethereal Labs, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
7. Legal compliance. You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third-party terms. You must comply with applicable third-party terms (for example, your mobile carrier's terms) when using the App.
10. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Once you accept this EULA, Apple has the right (and is deemed to have accepted the right) to enforce it against you as a third-party beneficiary.

9. Terms for apps downloaded from Google Play

If you downloaded the App from Google Play, you also agree to the Google Play Terms of Service. Google is not a party to this EULA and is not responsible for the App or its content. Ethereal Labs is responsible for the App, its support and any claims relating to it.

10. Governing law

This EULA is governed by the same law and dispute terms as section 14 of the Terms of Service.
